2.19 UPDATE: It has been confirmed that both brothers involved in the alleged attack on Jussie Smollett have told police that Mr. Smollett was involved in creating “threatening” letter(s) sent to him on the set at Empire. Additionally, Cook County S.A. Kim Foxx has recused herself from the case per CBS Chicago.

It has also been uncovered that Smollett was charged in 2007 for providing false information to authorities and pleaded guilty to a DUI in the same year.

It is also being reported that the actor may be adding LA defense attorney Mark Geragos to his team of attorneys. Geragos represented big names such as Michael Jackson and infamous Scott Peterson in the past.

Authorities wish to re-interview Smollett but are not sure if he will willing to comply at this point.

2:25PM 2.18 UPDATE: Local reporter Charlie De Mar tweets that he has spoken with both Nigerians brothers, previously detained by Chicago PD as persons of interest. They claim that they are American citizens, not homophobic and not anti-trump. Sources say that he was not pleased with the lack of reaction when racist and homophobic letters sent to him not only contained threats, but also a white powder. The powder turned up to be ground-up aspirin.

(CBS) –“Empire” actor Jussie Smollett, upset after a racist letter sent to the show’s studio didn’t get a “bigger reaction,” is suspected of paying two men to attack him a week later, according to multiple sources with direct knowledge of the investigation.

“When the letter didn’t get enough attention, he concocted the staged attack,” a source told CBS 2 Investigator Brad Edwards. Other sources corroborated that information.

2.18.19 UPDATE: Speaker Nancy Pelosi has deleted her previous tweet regarding her support for Jussie Smollett.  Mr. Smollett’s crisis management team advises that they will be releasing a statement today but will not confirm if/when Jussie will be meeting with Chicago PD to discuss further. They would not confirm whether or no Jussie will be speaking with Chicago PD further.

UPDATE:  Smollett’s management team has now retained attorney Anne Kavanagh. according to CBS Chicago.

Things keep looking worse and worse for Jussie Smollett with each day.

After hiring high-profile attorney Michael Monico, as well as Todd S. Pugh and Victor P. Henderson, the Empire actor is maintaining his innocence and a furious response to his doubters who, including the police, are calling the entire situation a hoax. Statement from Smollet’s attorneys below.

Reports are indicating that the actor actually rehearsed the “attack.”

Two law enforcement sources with knowledge of the investigation tell CNN that Chicago Police believe actor Jussie Smollett paid two men to orchestrate an assault on him that he reported late last month.

Smollett denies playing a role in his attack, according to a statement from his attorneys.

The men, who are brothers, were arrested Wednesday but released without charges Friday after Chicago police cited the discovery of “new evidence.”

The sources told CNN the two men are now cooperating fully with law enforcement.

Smollett told authorities he was attacked early January 29 by two men who were “yelling out racial and homophobic slurs.” He said one attacker put a rope around his neck and poured an unknown chemical substance on him.
The sources told CNN there are records that show the two brothers purchased the rope found around Smollett’s neck at a hardware store in Chicago.

Smollett’s attorneys, Todd S. Pugh and Victor P. Henderson, issued a statement to CNN Saturday night saying Smollett was angry about these latest developments.

“As a victim of a hate crime who has cooperated with the police investigation, Jussie Smollett is angered and devastated by recent reports that the perpetrators are individuals he is familiar with,” the statement read. “He has now been further victimized by claims attributed to these alleged perpetrators that Jussie played a role in his own attack. Nothing is further from the truth and anyone claiming otherwise is lying.”
